On the heels of ECOWAS Court ruling on the case of the former
national security adviser, Sambo Dasuki, a legal practitioner Samson Ameh (SAN)
has likened the ECOWAS Court to a toothless bulldog.
Speaking to journalists, he said the ruling which came with
N15m fine is more like a policy which is not enforceable.
Hear him: “ECOWAS
court can entertain cases, but it has no infrastructures to enforce its
judgments. It is the country from where the case came from, that it would rely
upon to enforce the said judgment,” the lawyer said.
When asked if the federal government is legally bound to
enforce the ruling, Ameh explained that, “any country has the right to enforce or
fail to enforce the judgment. There are no side effects legally, except that
the image of the country may be lowered. It is like a moral, rather than a
legal responsibility.”
Meanwhile, the Federal Government of Nigeria has reacted to
the ruling saying it will study the proceedings and judgment.
The Attorney General of the Federation and Minister of
Justice, Abubakar Malami, who was speaking through his Special Adviser, Salihu
Isah, said thus: “We cannot just react. We will first of all study the judgment to
understand its content before taking a stand,” he stated.
Dasuki, a former Security Adviser was arrested in November
2015 for allegedly diverting billions of dollars meant for purchase of weapons
to fight the deadly Boko Haram sect. Dasuki was also accused of illegal
possession of arms.
